Details of a recent house clearance in Essex carried out by Jeffrey Avery & Associates – Location Basildon

We were instructed to carry out this Basildon house clearance by a client who had recently lost his brother, and had travelled from the west country to get the property cleared. After meeting the client at 8am we started to clear the fairly well furnished semi detached property. We removed a fridge freezer, washing machine, cooker and dishwasher from the kitchen along with pots pans food from the cupboards and the usual amount of cutlery and crockery. The utility room had a tumble drier and a chest freezer which we also carried out to the truck.

Moving on to the lounge diner we cleared a table and chairs, sideboard, 3 piece suite side tables books music system videos and cd’s most of which were clean and re-usable. This was all loaded into our removals lorry, and the waste into another truck. Bedrooms comprised of 2 double and 1 single bed, a number of cabinets wardrobes and chests, with a dressing table. There was bedding scattered around and clothing out of cupboards, which was all removed quickly by our team.

The loft had a few empty boxes and the usual Christmas tree and decorations, which we took downstairs. The garden shed had a variety of tools a mower and other electrical gardening tools all in working order. The garden had 2 benches to be removed along with the contents of a small green house full of plastic pots. Ceramic flower pots scattered in other areas of the garden.

We cleared all of the items above and swept the shed and greenhouse clean, finally going from room to room with the hoover – Job done !

Whole clearance completed in 7 hours and our customer was very happy.

Valuing Flats With Short Leases – The Difficulties For Valuers

Our duty to undertake valuations vary in terms of purpose, albeit for secured lending, capital gains tax, probate, matrimonial, amongst others.  The method of valuation applied for residential valuation is normally the comparable method, except for some circumstances eg a residential building used as a house in multiple occupation, where an investment method may be used.

One area, which challenges the valuer of residential property, is flats with shorts leases.

Due to the limited access to secured lending and reduced marketability of these types of properties, these flats are harder to sell, and as such, more difficult to value.

We as a firm, are well versed in valuing the premiums to extend short lease flats by the statutory 90 years, however most valuers do not have this expertise.  Thus, as lease extension practitioners and part of our valuation service, we would first value the premium to extend the lease, and then deduct the premium figure from the extended lease value of the property.  We would then take a view as to what kind of further discount, in a hypothetical world, we would apply, in order to arrive at the short lease value of the property.

There may be other ways to arrive at the value, the easiest being to source short lease flat deals as part of the comparable evidence.  However, our method, in our professional opinion, gives a more valid opinion as to the market value taking account of all the scenarios surrounding problematic property, that can be – flats with leases with a short unexpired term.

Reptiles Rescued from Hoarder Go to Gatorland – Hoarder’s Help

Although hoarding usually involves the storing away of items such as newspapers, cardboard and magazines, it can sometimes lead to the hoarding of animals, and this is one of the most serious types of hoarding.

The most common types of animals to get hoarded in this way are usually dogs, cats and other household pets. However, more unusual animals can sometimes get hoarded as well, such as reptiles.

This was the case recently when a hoarding case was uncovered in Arizona. The case was featured on a show on Animal Planet, and a man was hoarding away a number of snakes and reptiles which had become a danger.

Although many people do not like the idea of reptiles in the home, for some it becomes a habit. But it can get out of hand when compulsive hoarding is the reason for the collecting, and as a result the animals were taken to safety.

Once rescued, the alligators and four large pythons were transported 2,500 miles from Arizona to Orlando. The Phoenix Herpetological Society then traded the animals for four crocodiles with Gatorland, which took them all to safety.

One of the snakes was a Tiger Reticulated Python which was over 18 feet long. This has now become the biggest snake at Gatorland.

Now the animals are going to be rehabilitated, and after they have gone through quarantine they will be able to enjoy a better life.

Granddaughter Cut Out of Will Because of Her Lifestyle – IHT News

A 28-year-old woman has been cut out of her late grandmother’s will because it was claimed that her grandmother did not approve of her lifestyle and would not have wanted her to inherit part of her estate.

The Telegraph recently reported on the surprising case, where the three surviving children of the deceased took Mrs Barrett to court because they claimed that a mistake on the will had led her and her brother to benefit from the inheritance that her grandmother would not have wanted her to have.

The grandmother, Bridget Gabrielle Murray, was a staunch Catholic, and her three surviving children claimed that she was not happy that Mrs Barrett was living with her partner out of wedlock for 18 months.

Despite the fact that Mrs Barrett got married to her partner, the children claimed that their mother would never have wanted to give her a share of the £220,000 inheritance because of her lifestyle.

The case was taken to the High Court because the children of the deceased claimed that the will which had been made a few months before she had died contained a mistake in its drafting which left some of the estate to Mrs Barrett and her brother.

The children claimed that their mother had not wanted any of her estate to be left to her grandchildren, and this was accepted by Robert Miles QC.

As a result, Mrs Barrett and her brother were taken off the will and are not set to benefit from any of the estate. Their mother was Mrs Murray’s youngest daughter, but she died before Mrs Murray.

Despite the fact that the defence lawyer said it would be “very unusual” for Mrs Murray to leave her grandchildren out of her will, the argument that she would not have wanted them to share in her estate stood, and the estate will now be shared out between her three children.

Will Error Leaves Son Without Inheritance – IHT News

Wills are very important because they can help the deceased person’s wishes to be carried out as they intended when they pass away so that their estate is divided up appropriately.

However, sometimes things go wrong even when the person making the will has the best intentions, as was the case in a recent situation reported in Metro.

Terry Marley recently went to the Appeal Court in order to try and rectify a mistake made in the wills of his adoptive parents which meant that he could not inherit their estate.

Mr Marley was unofficially adopted by the Rawlings when he was 15 years old, and he lived with them and cared for them until they both died. Their wish was for him to inherit their estate rather than their two biological sons, and they both made wills expressing exactly that.

However, when they made their wills there was a mixup and they ended up signing each other’s wills instead of signing their own, which made them invalid.

The mistake was only realised when Mr Rawlings died three years after his wife, and Mr Marley discovered that he was not going to inherit the estate despite their clear wishes for him to do so.

He took the case to court, and it recently went to the Appeal Court, but Lady Justice Black said that the court did not have to power to amend the mistake. This was despite the fact that it was clear that he was the intended beneficiary of the estate.

Now the two biological sons are set to inherit the £70,000 estate, and Mr Marley is left having to pay the court costs of £25,000, which could rise even higher.

This case highlights just how important it is to ensure that not only do you have a will, but that the will is correct and legally binding to prevent such problems from occurring.

Hoarding Property Fire in Cleveland – OCD News

Fire is a real danger when it comes to hoarding cases, and it is something that every firefighter fears encountering. There are many problems caused by hoarding, such as vermin, mould and other health and safety issues. But when a fire strikes in a hoarding property, the results can be disastrous.

A fire recently caught hold in a property in Cleveland, as reported by the Fox8 website. However, when firefighters arrived on the scene to find that the fire was quickly spreading, they discovered that the property belonged to a compulsive hoarder.

Larry Gray, the public information officer for the firefighters, was quoted on Fox8 as saying that they encountered debris and items in every room, stacked up in piles, and as a result entry to the building became very difficult.

The fire occurred on the second floor of a property on West 83rd Street, and caught alight in the afternoon. At first the firefighters thought that someone was inside the building, and they entered in through the back.

However, the fire caught hold too quickly and the team could not stay inside the building, so they had to leave. Luckily, they were informed that the occupant was out shopping at the time so it did not turn into a tragic incident.

Apparently the smoke detectors were not working in the building, although it as yet remains unknown why it caught hold in the first place.

The problems caused by hoarding when a fire catches alight are that it gets hotter quicker, visibility is diminished quicker, and it becomes much more difficult to get around, which is more dangerous for the occupants and the firefighters.

Hoarding Workshop Helps Hoarders in Iowa – Latest News

The Times Republican recently reported on a hoarding workshop which has been set up in Marshalltown, Iowa, to provide help and advice to hoarders so that they can start to regain control over their destructive habit.

The workshop is run by a retired social worker, Ron Palumbo, and is held at Iowa Valley Continuing Education.

This is an excellent way to provide knowledge, support and awareness of the mysterious condition of compulsive hoarding. Although the condition has got more awareness over recent months with programmes such as A&E’s ‘Hoarders’, it still remains relatively misunderstood.

In the article, Palumbo said that hoarding is a type of OCD, and that in his 30-year career as a social worker he had only seen one hoarding case. But despite the relative rarity of the condition, awareness is increasing and every week new cases are reported.

The problem with hoarding is that the actual hoarders rarely seek out help themselves. Instead, it is often left to friends or family members to get help and support.

The article also quoted Michelle Spohnheimer, who is the housing and community development director in Marshalltown. She said that she encountered cases when performing home inspections, and that she has realised that hoarding victims can be anyone, irrespective of their social background.

For her, the biggest problem with hoarding cases is the safety issue that they create. Mould and vermin are two common but serious problems that can arise from hoarding, and then you cannot overlook the safety issues posed by the increased risk of fire.

Hoarding is a very serious and still misunderstood condition, but with workshops like the one offered in Marshalltown, hopefully hoarders in the area can start to get back control over their lives and stop hoarding for good.
